Is there anything in Australian law preventing Chris and his family from suing the Prosecutor and any Police Officers involverd with the investigation personally?

Do lawyers have to carry malpractice insurance? That's the only way I can see a verdict being enforceable, as I doubt that the cops or prosecutors would have much in the way of assets.

It's worth a shot. They took five years of his life, I don't see why he shouldn't hire the meanest tort attourny he can find and take five years worth of their livelihoods from them for being a bunch of fuck-ups.

Per this post earlier in the thread

"Individuals wrongfully convicted and imprisoned do not have a common law or statutory right to compensation in any Australian jurisdictions other than the Australian Capital Territory (ACT). However, a state or territory government may choose to make an ex gratia payment either on its own accord or as a result of a request by a party for such a payment."

Durandal and I sent as much as we could reasonably afford given the economy. I wish we could do more though; aside from the $8k legal bill he has the last 2-3 years of his life to make up for and it would be nice if he had some cash to help him out with it.

Western Australia has compensated some wrongful convictions, although they were high profile cases with lots of supporters, whilst I don't know how high profile Chris's case is, since I live in a different state. Also note when WA compensated those people, the economic climate was good, I don't know how this will play out with a recession looming.

Thank goodness. This is fantastic to hear. Good on the prosecutor, too. It's nice to know there are some lawyers who wouldn't eat their own children if it came to it.

As pleased as I am that Chris is going to be released and his record expunged this really isn't fucking good enough. I remember copy typing scans of the transcripts, with many other people here, and the whole fucking case amounted to character assassination and lazy assumption. The fact of the matter is Chris lost 5 years and I think just as importantly the fucking real killer is still walking the streets because the cops and prosecutors couldn't be arsed removing head from anus. Fuck them and fuck anyone who even looks like them.
