What kind of fucked up idiots plan to murder the customers at a Subway they're robbing? The place wouldn't even have half as much money in it as a gas station, let alone a bank.

They may have just been forcing him in there so he wouldn't get in the way, but if I had a gun and they tried to move me to a secluded area of the store I'd fight back too.

No, robbers generally only do that if they plan on killing them. Too bad the other asshole isn't dead as well.

The ironic thing is that if they'd just run in, punched the guy behind the counter, and grabbed the cash drawer, they'd both be alive and have the cash right now, and would probably never be caught.

Not so; Florida is a Castle Doctrine state; a citizen who kills or wounds a perp who's been threatened by a perp can't be sued by either said perp or his family. A lot of states are Castle Doctrine now,

Good for the Marine! I hope somebody compensates him for the cost of the ammunition.

Wow, they named a doctrine after The Punisher?

Nobody ever said these jokers were bright. I got a job at a Subway in Calgary shortly after turning 18 without a resume, but the owner felt that as a dude, I was less likely to be killed by a crackhead with a hammer for the $50 in the register like the girl she had in the shift I was filling.

Your Grace, if you go to the Texas Department of Justice Death Row Homepage, they give the charge sheets for people who are on death row. If you look at the ones where the murder(s) took place as part of a robbery, the majority of them are for less than US$100 and a large number are for US$20 - 30. The Clark County DA's office does a very interesting list as well; that one's country-wide and shows much the same thing. It also gives what the unlamented departed chose for their last meal.

The girl who had the job before you was whacked? I hope you were carrying when you started your shift each evening. These crackheads tend to come back.

That's Castle as in my home is my castle and any violators can be shot, not Frank Castle. It also extends towards self-defence situations where a man believes his life & limb is in danger.

It's a nice thought but I fear not. It's after the "Your Home is Your Castle". What the Castle Doctrine states is that in your home, on your property or in your place of business, you are under no obligation to retreat if threatened. You are also allowed to defend yourself if attacked or threatened with a lethal weapon and will not be subject to civil action by the perp or his relatives.

Could it be the other way around? Frank Castle named after this idea? Or am I searching for too much depth in comic books?

This is not vigilante justice. Vigilante justice would be if an unarmed man went up to the register and handed over a note asking for the cash inside, and then someone pulled out a gun and shot said unarmed man in the back off the head.

Heh. There's a lot of retired Marines being badass lately; first the guy who killed the bear with the log, then the one who broke the hand of a guy trying to pick his pockets (I don't think that one was posted here), and now this.

Yeah, technically, it's definitely self defense.

I still say he's a vigilante though... I bet his real name is something like "Clutch" McCloud, and he probably drives a cool car too. Like a late 70's model convertible that was supplied to him by an ultra secret government agency with a cool name like U.N.C.L.E...., that is until they went too far and ordered him to kill innocent civilians. That's when he took the law into his own hands... Using his marine special forces training, he went off on his own and had to lay low. He got a job at Subway because he realized he could fight crime from there...

Damn, now I just need some cool theme music...

He didn't, he was long behind bars by then. Even so, that wasn't the brightest job to take, but they didn't exactly tell me all of this until I'd been working there for a few months and needed the income.

No , New York is not a Castle Doctrine state.
For I dipt into the future, far as human eye could see,
Saw the Vision of the world, and all the wonder that would be;
Saw the heavens fill with commerce, argosies of magic sails,
Pilots of the purple twilight dropping down with costly bales;
Heard the heavens fill with shouting, and there rain'd a ghastly dew
From the nations' airy navies grappling in the central blue;

Regrettably no. The ten Castle Doctrine states are Alabama, Arizona, Florida Georgia, Idaho, Indiana, Kentucky, Oklahoma, Mississippi and South Dakota. In addition, Castle Doctrine acts are going through the legislature in Alaska, Arkansas, Michigan, Minnesota, Missouri, New Hampshire, Ohio and South Carolina.

In NY, the Sullivan Act effectively prevents average citizens from carrying unless they have a permit that's almost impossible to get. So, in the same situation in NY, the staff and customers are dead.

Texas is as well. They passed the bill recently.

It should also be noted that Colorado is a "Make My Day" state, though as far as I know we don't have any Castle Doctrine.
