IIRC just before the movies came out Christpher Tolkien seperated himself from the movies.

Because Christopher Tolkien and the rest of the family made it known that the didn't feel a film was appropriate. So in the grand schemes of things their opinion of the movie is largely irrelevant. Some people obviously care what their opinion is or they wouldn't be asked on a regular basis. But you're right that in a legal sense their input doesn't matter.
