It would be interesting to see an essay analysis comparing TOS and TNG legal practices. Unfortunatally the only real TOS referenses are the trial of Kirk and the trial of Scotty(forget episode). We have Kirk's trial in ST VI but that's a Klingon trial.

Regaurdless it does appear that ethics are much different in TNG. In drumhead Nora Sati is running around doing a veritable Witch Hunt and not once is anyone being told they are being accused of anything! Her use of a full Betazed(or was he) is also interesting as well.
