I'm going to quote myself from another thread:
Canada has four basic bulwarks against lawsuit abuse:
  1. Loser pays. In fact, the plaintiff may even be forced to provide a security deposit up-front in order to cover the defendant's legal costs if he should lose and be unable or unwilling to pay up.
  2. Much more restrictive discovery rules. In essence, you can't just demand piles of evidence from everyone remotely involved in the case; you must show relevance first.
  3. Lawsuits are normally evaluated by judges, not lay juries. This greatly reduces the effect of bias, courtroom theatrics, and monetary inflation of awarded damages.
  4. Damage caps; judges routinely limit damages. Punitive damage awards are infrequent and far smaller, with no automatic tripling as we see in certain types of American lawsuit. Most pain and suffering lawsuits cap out at $50,000 or less, with multi-million dollar awards being essentially unheard-of.
Fixing the American lawsuit lottery is not just a matter of "loser pays"; there are many other serious issues that must be examined, particularly the use of jury trials. America is by far the most litigious nation in the world, and it is a direct result of your completely fucked-up laws.
Applies here too. America is the land of lawsuits because it's almost impossible to recover legal costs from a litigious plaintiff, trials are by jury, discovery procedures are a joke, punitive damages are out of control, and damage awards in general are out of control. That's why you see this bullshit.

She sued McD's. And there is an extremely overweight man trying to sue McD's, BK, KFC and Wendy's for the same reason. People will do anything for a buck in the US.

It's truly ridiculous. The girl involved in this lawsuit is something like 14 and weighs in at about 400 pounds (about 180 kilos). I'm sorry, but no one just wakes up one day and finds that they weigh that much. It's a slow, gradual process, and this girl clearly could have stopped eating at McDonalds any time she wanted to to help herself. She is personally accountable for not getting exercise during that time, for not recognizing that she needed to change her dietary habits and her lifestyle, and for not reading the signs that were in the McDonalds revealing the nutritional information of the food she was eating. Her parents need to be responsible for allowing her to be the way that she is, and it's not McDonald's fault for serving the food that she chose to buy and eat.

Wow. What's really sad about this is that if someone tried to sue the U.S. Government for making them stupid (pubic skeuling), they'd get laughed out of court, even though that case is far more valid than the McDonalds one.

I will make one small change when I become Supreme Ruler of Earth.

Punitive damages will be unlimited, but they won't go to the defendent. They will be used to fix the problem created to reduce the chances of this happening in the future.

BTW, the McDonalds in France are airing ads which state, 'There's no need to abuse fast food, or eat at McDonalds more than once a week.' You can imagine the US McDonald's reaction to that.

On that subject, did you hear of the parents who sued Hasbro after their kid choked to death on one of their power bouncers? I'm suspecting they let it happen. The kid was 4 years old, and autistic. Autistic kids require constant supervision, and anyone with a functioning brain wouldn't give an austistic kid of that age such a toy.

Also, did you hear of that woman that sued Burger King because a woman sued Burger King because she was too dumb to keep one of those promotional balls away from her baby son? It's stupidity in action, people.

Then, there was that mother that sued because she spent too much money on pokemon cards for her kids. :roll:

The US needs an amendment that would make such frivolous and idiotic lawsuits impossible. I don't want to see humankind sink any lower than it already has.
