I think the best explaination is that the current Rules are actually fairly recent and the "tens of thousands of years old thing" is a marketing gimmick.

Not according to my encyclopedia.

Rule 17: A contract is a contract is a contract but only between Ferengi.

In Enterprise (Canon, even for the stubborn bastards who refuses to accept it) the episode 'aquisition' implies that Vulcans/Ferengi are unaware of one and other.
