Y'know, if I lived in Texas, I would be MORE than happy to be caught fucking another dude. In fact, I'd make a show of it. And if they arrest me for it and throw me in prison, THAT'S JUST FINE BY ME! I mean hey, apparently some of the best sodomy happens behind bars anyway. :wink:

Some of the best PORNO happens behind bars, but from what I'm told, there isn't nearly as much sex in prison as we're led to think.

Is that because there aren't as many bubbas per capita in prison as thought by others?

As for this story, it's unjust to have a law punishing a victimless crime such as consenting sodomy between two people. It gets worse when someone uses that same law to discriminate against groups they don't particularly like.

Hopefully this will get a fundamentally unjust law overturned. As Stravo said courts generally don't cases from cases unless they intend to overturn them, doubly so for the Supreme Court.

I think the law has a very good chance of being overturned this time. The Cato Institute and the Institute for Justice have filed friend of the court briefs - The Institute for Justice wasn't around in '86 and the Cato Institute wasn't filing legal briefs - and a coupled of the Supreme Court Justices are libertarian-constitutionalists and may be more inclined to listen to that line of argument, which could produce the necessary margin.
