'This is major': Gay marriage supporters rejoice in Chicago

Robyne O'Mara and Lynne Burnett have been together 33 years, and on Tuesday they watched, almost in awe, as Illinois lawmakers cast votes that would make the couple's decadeslong relationship equal to any other.

"We were just blown away," O'Mara said after the General Assembly passed a bill to legalize same-sex marriage. "I think the momentum in our nation has convinced people. It's been an amazing ride the past several years. We're so grateful the legislators took it upon themselves and recognized that every citizen has the right to marry."

Across the state, gay and lesbian couples and their advocates celebrated as Illinois was poised to become the 15th in the country to allow same-sex marriages. The bill will now go to Gov. Pat Quinn, who has said he will sign it into law.

Bernard Cherkasov, CEO of the gay rights group Equality Illinois, reflected on the end of a yearslong legislative battle: "The first thought that popped into my mind was all those families around the state that I've met over the past five years in fighting for marriage equality. The couples, their parents, their children, all who have waited for this moment.

"And I thought about my own daughter, who is 4 years old, that she will grow up not knowing that the first four years of her life were spent with the state treating her family as second-class citizens. Instead she will grow up with the equal dignity and respect that she deserves."

Opponents of the bill expressed disappointment with the vote and fears that the law will infringe on religious freedoms.

The Catholic Conference of Illinois said in a statement that it is "deeply disappointed that members of the General Assembly chose to redefine what is outside of its authority: a natural institution like marriage. We remain concerned about the very real threats to religious liberty that are at stake with the passage of this bill."

Bishop Larry Trotter, another staunch opponent of the bill, said in a statement that he applauds those who voted against the bill "for standing their ground in their defense of traditional marriage in Illinois."

"(W)e will always believe that marriage is between one man and one woman," Trotter said in the statement. "Yet we will still love the members of the LGBT community."

Earlier this year, the Sidetrack bar in Lakeview had ordered a banner in preparation for an anticipated vote on the marriage bill in March. But that vote never came.

Shortly after passage of the bill, the bar employees hung up the banner, which read: "November 5, 2013, Marriage Equality Passes in Illinois!"

"We knew the banner would go up one day," said Chris Hill, who handles advertising for the bar. "It was just a matter of what date we were going to stick on it."

Mayor Rahm Emanuel dropped in at Sidetrack and another bar, Roscoe's, on Tuesday evening to congratulate supporters of same-sex marriage on the victory.

"This is a time when our laws are in line with our values," Emanuel said.

Sandra Simmons, 64, was at a weekly seniors get-together at the Center on Halsted, a gay and lesbian community center in Chicago, when she heard news of the vote.

"You hope against hope because with all the other disappointments that have occurred in the legislature, for them to finally do something good, it's nice," Simmons said. "This is major."

Camilla Taylor, an attorney with the gay rights group Lambda Legal, applauded the 61 House lawmakers who voted in favor of the bill.

"We were hopeful, we were very optimistic," Taylor said. "We expected there would be a lot of courageous legislators who maybe hadn't made their courage known beforehand, and we were rewarded."

Ed Yohnka, spokesman for the American Civil Liberties Union of Illinois, said: "The truth is that this is really a victory for the thousands of couples and their families across the state of Illinois who are going to wake up and read in the paper that a majority of the leaders in this state now believe they are equal to everyone else."

Lambda Legal and the ACLU are involved in a lawsuit challenging the state's ban on same-sex marriage. If Quinn signs the same-sex marriage bill into law as expected, Yohnka said the groups would "look at not moving forward with the lawsuit at some point in time."

While many religious groups opposed legalizing same-sex marriage, those that supported the bill applauded Tuesday's vote.

"I'm ecstatic," said the Rev. Richard Tolliver, rector of St. Edmund's Episcopal Church in Washington Park. "I just knew it would happen. I just didn't know when. It's another step for social justice."

O'Mara, the woman who watched the vote with her partner, said her nephew performed a ceremony for the couple after the state legalized same-sex civil unions.

Looking ahead to the possibility of same-sex marriage licenses being issued in June, O'Mara said: "We're going to have to call him back. It might be time for a repeat."

On top of the fact that Terry McAuliffe was elected over Cuccinelli, I'm giddy over how NOM's been virtually losing every major electoral, legislative and court battle (with exception to North Carolina) for the past 4 years. Here's to hoping the Hawaii comes out as the 16th state to legalize marriage for same-sex couples and the next defeat for those swindling assholes.

I think we're hitting the steep part of the logistic curve for gay marriage. With several states having passed it in 2008-12, and with the world having conspicuously failed to end, the opponents are having to fight a much more defensive battle. They can't just say "this is the status quo and let's keep it;" losing in one place weakens their ability to hold on in other places.

A lot of the deep red red states are going to hold out for a long time, in all probability, but I think that within the next few years we're going to hit a tipping point of at least half the states acknowledge gay marriage. Unfortunately, bringing the other half on board may take a generation or two, but it at least gives gay couples realistic choices should they wish to vote with their feet.

New Mexico is overwhelmingly likely to be the next one with its supreme court likely to rule before the end of the year.

Based on the fact New Mexico does not have a law explicitly banning gay marriage or a constitutional ban, along with the composition of its supreme court and the nature of the questions during recently oral arguments concerning the pending gay marriage case, I expect the court to end up with a ruling of some sort declaring gay marriage legal in New Mexico.

Oregon is likely next in 2014 given its political leanings, but after that it tends to get potentially harder since almost all the remaining states have constitutional bans in place. (And tend to be less inherently favorable towards gay marriage right now or simply have procedures that much it difficult to vote on an amendment with Republicans potentially able to block it coming to a public vote in some states for awhile. The extreme case is Florida where because a constitutional ban is now in place 60%+ of the voters now have to vote in favor of a new amendment in order to get a rid of a constitutional ban that way.)

Basically I could see 2 or 3 more getting gay marriage passed via amendments by 2016, but I would expect that unfortunately further progress during the state political route would not be until 2018 or later. (While there may be a real shift in popular opinion going forward, unfortunately once you go beyond certain states the remaining ones that might plausibly put an amendment to the voters by then the problem is they are simply redder states where popular opinion has further to realistically go.)

This does not rule out progress via the judicial route in individual states though. You also have future federal challenges to gay marriage potentially reaching the Supreme Court with a background of a significantly greater number of states having legalized gay marriage than the last time around.

The other notable area of challenge will be the issue of couples having been legally married in one state not getting recognized in another state with a ban still in place. In particular there is a case in Ohio where a judge ruled in favor of the challenge while noting how while Ohio ban's of first cousin marriages and marriages below a certain age does not prevent them from legally recognizing those marriages when they occur in other states, it appears to rather uniquely single out gay marriages from other states for non-recognition. This approach could basically defacto legalize gay marriage everywhere, with gay couples simply having to go to somewhat more trouble to get married initially but otherwise their marriages are treated the same. (I would expect in that scenario some gay couples to simply effectively combine their honeymoon trip with their trip to get married in another state.)

I dunno I think those of us for whom these decisions and potential social effects have significant impact on our lives probably had some idea of how this could be something to pay attention to.

But yeah those of you who tune in just for the fun of seeing the Other Team lose are important too I guess :L

I have difficulty believing that gay marriage can truly have any negative impact on people. I mean if you disagree due to religious or personal reasons, fine. But does it invalidate your existing marriage? Does it cause you physical or financial harm?

Short of outright bigotry, I simply cannot understand how gay marriage can actually be a threat to anyone.

Don't misunderstand me; I'm pro-LGBT rights and I want to see all states approve gay marriage.

It's just that I came of age during the Bush II-era. And after nearly a decade of 'We have to protect American traditions/Family Values" being shoved down my throat, I can't help feeling some schadenfreude at watching anti-LGBT elements flip the fuck out.

You can be such a downer sometimes, Jogurt. Of course we care about social justice and the people effected. That's why we're happy.

Seeing repressive cavemen lose their shit is a lovely side benefit though.
