Personally I think Data does deserve the rights and priveledges a biological would enjoy. Data was proved to fit the three requirements for life. Data's deserving of sentience is a bit of a touchier subject, it all really depends on your opinion. I know Trek fans who think Data should not have been acknowledged as a living being, I disagree with them, but that's my opinion and that's their's. Data's right to be free isn't something that can be proved or disproved like the myth that the Federation is an evil fascist state. It all boils down to what your values are. I personally think that life, true life, is not defined by whether not someone is made of flesh or artificial materials or whether or not somebody was borne by a natural biological process or built.
Boy, the bullshit-o-meter is off the charts...

Yeah it was pretty good, I kind of wish I hadn't read the spoilers for it ahead of time so I didn't know what was going on at first, but I just can't help myself, and I'm working on a Stargate SG-1/Star Trek empire builder rpg, so I have to keep versed on new techs and anything that might effect it.

IDMR: Well its basically social services taking the Kid because data was judged to be an unfit parent - so you see it happens nower days.
However Picard refused to let her leave the ship - he offered to warp into earth orbit and stop off at the federation supreme court where he would have done a great speech, the admiral would realise his error and everyone would have gone about their business.

I put it to you that they were clearly more interested in Lal's (that's the android's name, right?) technology than anything else. And that probably would have been how it would have happened in a TNG episode, but one must suspend disbelief when discussing these things.

Yes I agree they were interested in the tech more but they probably did believe Data to be unfit.
However we have seen Datas rights be threatened before and the courts ruled in his favour - they couldnt have done otherwise since htere was already law supporting Datas position.
However the point here is if the Federation brainwashed everyone to submit to the state Picard would have just handed her over and that would have been the end of it.
