Police 'showdown' over Schiavo averted

By CAROL MARBIN MILLER
Miami Herald

PINELLAS PARK, Fla. — Hours after a judge ordered that Terri Schiavo was not to be removed from her hospice, a team of state agents were en route to seize her and have her feeding tube reinserted - but they stopped short when local police told them they would enforce the judge's order, The Miami Herald has learned.

Agents of the Florida Department of Law Enforcement told police in Pinellas Park, the small town where Schiavo lies at Hospice Woodside, on Thursday that they were on the way to take her to a hospital to resume her feeding.

For a brief period, local police, who have officers at the hospice to keep protesters out, prepared for what sources called "a showdown."

In the end, the squad from the FDLE and the Department of Children & Families backed down, apparently concerned about confronting local police outside the hospice.

"We told them that unless they had the judge with them when they came, they were not going to get in," said a source with the local police.

"The FDLE called to say they were en route to the scene," said an official with the city police who requested anonymity. "When the sheriff's department and our department told them they could not enforce their order, they backed off."

The incident,known only to a few and related to The Herald by three different sources involved in Thursday's events, underscores the intense emotion and murky legal terrain that the Schiavo case has created. It also shows that agencies answering directly to Gov. Jeb Bush had planned to use a wrinkle in Florida law that would have allowed them to legally get around the judge's order. The exception in the law allows public agencies to freeze a judge's order whenever an agency appeals it.

CONSTITUTIONAL CRISIS

Participants in the high-stakes test of wills, who spoke with The Herald on the condition of anonymity, said they believed the standoff could ultimately have led to a constitutional crisis and a confrontation between dueling lawmen.

"There were two sets of law enforcement officers facing off, waiting for the other to blink," said one official with knowledge of Thursday morning's activities.

In jest, one official said local police discussed "whether we had enough officers to hold off the National Guard."

"It was kind of a showdown on the part of the locals and the state police," the official said. "It it was not too long after that Jeb Bush was on TV saying that, evidently, he doesn't have as much authority as people think."

State officials on Friday vigorously denied the notion that any "showdown" occurred.

"DCF directed no such action," said agency spokeswoman Zoraya Suarez.

Said Bush spokesman Jacob DiPietre: "There was no showdown. We were ready to go. We didn't want to break the law. There was a process in place and we were following the process. The judge had an order and we were following the order."

Tim Caddell, a spokesman for the city of Pinellas Park, declined to discuss Thursday's events.

SHELTER FOR SCHIAVO

The developments that set Thursday morning's events in motion began the previous afternoon, when the governor and DCF chief Lucy Hadi held an impromptu news conference to announce they were considering sheltering Schiavo under the state's adult protection law. DCF has been besieged, officials say, by thousands of calls alleging Schiavo is the victim of abuse or neglect.

Alerted by the Bush administration that Schiavo might be on her way to their facility, officials at Morton Plant Hospital went to court themselves Wednesday, asking Circuit Judge George Greer, who ordered the removal of Schiavo's feeding tube last week, what to do.

"It's an extraordinary situation," said Beth Hardy, a hospital spokeswoman. "I don't think any of us has seen anything like it. Ever."

Greer signed an order Wednesday afternoon forbidding DCF from "taking possession of Theresa Marie Schiavo or removing her" from the hospice. He directed "each and every and singular sheriff of the state of Florida" to enforce his order.

But Thursday, at 8:15 a.m., DCF lawyers appealed Greer's order to judges at the Second District Court of Appeal in Lakeland.

That created the window of time to seize Schiavo. When DCF filed its appeal, it effectively froze the judge's Wednesday order. It took nearly three hours before the judge found out and canceled the automatic stay, shortly before 11 a.m.

Administrators of the 72-bed hospice, who have endured a withering siege of their facility by protesters since Greer ordered Schiavo's feeding tube removed on March 18, declined to discuss Thursday morning's events in any detail.

"I don't really know, or pretend to know, the specifics of what is going on behind the scenes," said Mike Bell, a spokesman for Hospice of the Florida Suncoast, which operates Woodside.

DCF INTENTIONS

According to sources, DCF intended to take Schiavo to Morton Plant Hospital, where her feeding tube had been reinserted in 2003 following a previous judicial order allowing its removal. But hospice officials were aware that the hospital was not likely to perform surgery to reinsert the tube without an order from Greer.

"People knew that taking [Schiavo] did not equate with immediate reinsertion of the feeding tube," a source said. "Hospital officials were working with their legal counsel and their advisors, trying to figure out which order superseded which, and what action they should take."

Hardy, the hospital spokeswoman, said she does not believe the hospital was made aware Thursday morning that DCF and state police planned to bring Schiavo in. "We were not aware of that three-hour period," she said. "It's not a discussion we even had, really."

George Felos, Michael Schiavo's attorney, said he does not think DCF officials knew of the window of opportunity they had created until well after they filed their appeal.

"Frankly, I don't believe when they filed their notice of appeal they realized that that gave them an automatic stay," Felos said. "When we filed our motion to vacate the automatic stay . . . they realized they had a short window of opportunity and they wanted to extend that as long as they could.

"I believe that as soon as DCF knew they had an opportunity, they were mobilizing to take advantage of it, without a doubt."

So this piece of shit did try to emulate the cracker governors who defied court orders during the civil rights cases. At least George Wallace had the balls to show up in person to block the feds. CLEARWATER, Fla. - Amid the pitched legal battle over Terri Schiavo that has been fought through his court, Pinellas County Circuit Judge George Greer has been under the protection of armed guards, and friends say his family also is protected.


Death threats have been made against him for allowing Michael Schiavo to remove the feeding tube that has kept his 41-year-old wife alive for the past 15 years, and the Southern Baptist church that Greer belonged to for years has asked him to leave the congregation.


Greer — a conservative Christian and longtime Republican known for an easy manner — has become the public face of the judiciary in this internationally watched fight. But despite the mounting pressure, he has been steadfast in his rulings that Terri Schiavo is in a persistent vegetative state and did not want to be kept alive artificially.


"There are very few people who have shown the will to stand up to raw power," said Stetson University Law Professor Michael Allen, who has studied the Schiavo case. "He's one."


"This is simply a case of people not liking this decision, and the fact that a judge is standing up to this is quite important," Allen added.


On Saturday, Greer rejected arguments by Terri Schiavo's parents, Bob and Mary Schindler, that their daughter tried to say "I want to live" before her feeding tube was removed March 18. They argued that she said "AHHHHH" and "WAAAAAAA" when asked to repeat the phrase.


Greer said that "all of the credible medical evidence this court has received over the last five years" suggests Schiavo's behavior is not a product of cognitive awareness. Doctors have said Schiavo's past utterances were involuntary moans consistent with someone in a vegetative state.


When informed of Greer's rejection, Bob Schindler reacted with somber sarcasm: "He did? Great surprise."


It was Greer who first ruled that Terri Schiavo was in a persistent vegetative state and would not want to be kept alive artificially. Three times he has ordered the feeding tube be removed, as requested by Michael Schiavo, and his rulings have consistently been upheld in appeals filed by the Schindlers.


Greer, 63, also stood up to congressional efforts to intervene in the case, rejecting an attempt by the House of Representatives to subpoena Terry Schiavo as a means to force the reinsertion of her feeding tube. Since then, other judges have followed in refusing to act under a newly crafted federal law allowing them to consider the case.


Greer, a former county commissioner, became a judge in 1992. He was recently re-elected to a six-year term, but has announced that he will retire once that term is up.


While in legal circles he is garnering acclaim for his consistent application of Florida law in the case, there has been a price.


Protesters now show up at his Clearwater home. The FBI (news - web sites) arrested a North Carolina man it said placed a $50,000 bounty on the head of a judge in the case, although officials didn't name the judge.


This past week, he parted ways with his Southern Baptist church, which had advocated keeping Terri Schiavo alive, after his pastor suggested it would be better if he left.


"You must know that in all likelihood it is this case which will define your career and this case that you will remember in the waning days of life," Calvary Baptist Pastor William Rice wrote to Greer in a letter than later became public. "I hope you can find a way to side with the angels and become an answer to the prayers of thousands."


Greer could not be reached for comment because of the frequent hearings on the Schiavo case, but longtime friend Mary Repper said she recently spoke with him and he sounds "worn out" by the case that has been on his docket for more than seven years.


"It's been going on so long and it's reached its fevered pitch," Repper said. "It's gotten so angry and so hostile, but he's still hanging in there."


Repper said Greer has taken comfort in being consistently upheld by higher courts, but his split with his church has been a blow.

"The people in that church should be ashamed of themselves, to demonize George and to ask him to leave for doing his job, for upholding the law," she said. "To me, that was the most offensive thing that has happened so far."

Greer has been asked to step down from the case five times and has refused.

Attorney Pat Anderson, who had represented the Schindlers for three years of the court fight, filed three motions for recusal but said she could not get Greer to budge.

"A lawyer told me when I first got involved in this case that he (Greer) does not have a reverse on his transmission," Anderson said. "He apparently is too prideful to say 'I made a mistake. I made a mistake because I didn't have all the information and I am sorry I made a mistake.'"

I've gotta say...for once, I'm proud of my state courts. About time they handed that hatfucker of a governor his ass and told him not to let the door hit him on the way out. He's a lame duck, the courts know it, and he can't bully them around. Hurrah for term limits!

And I think this is one of the first times I can honestly say there's a Republican in an elected office I would hug if I saw him on the street. OK, I'd like to hug...it might weird him out a bit, but finally someone has the courage to stand up to their own party and say "no."

Forgive me if this sounds crass, but am i the only one who feels only a passing sympathy for the Schiavos?

Firstly, Terri didnt get this way because someone (like her husband as some claim) hit her or beat her or from som unavoidable accident or health defect she got this way because she has bulimia (i dont knopw if i spelled that right) which is like an inch away from suicidal. She made herself this way, not on purpose but she might as well have!

Secondly i feel very littele for her parents, who i am sure knew what was wrong with her years ago. They probably feel guilty for blowing off the unmistakable signs of bulimia, like constant forced puking and weight loss, and now they want to 'make a difference', but they're a day late and a whole lot of dollars short. And dont argue they didnt know--you dont miss something like a girl dropping fifty pounds in a week or rushing to the bathroom to vomit after every meal. Hell i cough and my mom looks up and says "You ok?", so i know if i were force vomiting and loosing wieght constantly she'd notice almost instantly.

Thirdly i feel just enraged at how her family is whipping everyone up into a fury OUTSIDE OF A HOSPICE! There are people in there with terminal illnesses, who, as i understand it, are trying to die in peace. And meanwhile outside score sof peopel are screaminga nd crying out and beating on drums, it's obscene.

I knwo this position is crass and i dont care, i just feel really very little sympathy for them. I feel more sympathy for her husband, actually, since he and his family will be suffering through death threats and attempts on their lives for years to come. And no i dont give a fuck about him finding another woman, he shouldnt have to tie himself to a corpse forever thats retarded. Personally i would've let her parents have her long ago, but he seems to reallyw ant to fulfill her wishes, which is nice but stupid for him and thats why i feel sorry for him and his family.

Bulimia doesn't necessarily have the obvious weight loss seen in anorexics. Although their bodies inside are getting torn apart, outside they may look perfectly alright. If someone waited around until no one was nearby to vomit, people around might well have not known.
Thirdly i feel just enraged at how her family is whipping everyone up into a fury OUTSIDE OF A HOSPICE! There are people in there with terminal illnesses, who, as i understand it, are trying to die in peace. And meanwhile outside score sof peopel are screaminga nd crying out and beating on drums, it's obscene.
Well yeah, but those other people don't count. They haven't been sent by GAWD ALMIGHTY to be a tool of the Religious Wrong. (Yes, that was angry sarcasm. I agree with you.)
