An 81-year-old Stratford man has been charged with public indecency, accused of performing a sex act with some shrubbery.

Police tell the Connecticut Post they arrested Wallace Berg Monday after a neighbor showed them a video he took of a naked Berg in the bushes outside Berg’s home.

Police say the neighbor told them he confronted Berg who then stopped the indecent behavior, covered himself with a grill cover, apologized and went into his house.

Berg was charged with public indecency and second-degree breach of peace. He was released after posting a $10,000 bond and is due in Superior Court on Aug. 5.

He did not immediately return a phone call Wednesday from the Associated Press seeking comment.

I'm going to go ahead and defend this guy. So, yes, he is a shrub-fucker. This is established, and not admired by most people. But it was his own property, and I have strong doubts that the shrubbery objected. Is this really a matter of indecent behavior in public, or not having a substantial enough fence? What about the guy filming him? Isn't that kind of pervy itself?

If it's reasonably visible from the road or from neighboring houses, then it constitutes public indecency. Same reason how you could get nicked for walking around naked if your blinds are open and you can be seen from the road.

Surprisingly not Florida! But if the law in Connecticut are the same, then you cannot show tits or dangly bits outside if anyone can view you. Even if you're in a hot tub at 3am, in your own yard, and have a 6 foot tall wooden fence. If someone lives next door and can see you from their attic window and does so, it's public indecency. But I kinda doubt the law is the same since it was the bible thumpers in FL who in reality just wanted to ban women from sunbathing topless in their own backyards, because your rights stop where their bible begins.

I think it depends a great deal on reason too. If you are skinny dipping and you have a fence tall enough to block neighbors from seeing, and a cover or sunshade to keep people in attic windows from seeing, but some pervert stands on a ladder to peek over the fence...that's not something the skinny dipper should be prosecuted for.

Yeah, a lot can be hung on the words 'reasonable expectation of privacy'. A lot of subdivisions don't have (or allow) fences between houses, so it's quite possible that someone fucking their shrubbery might be visible from roads or neighboring backyards. Now if there was a tall fence and the neighbor actually had to work at getting a good view of the plant-fucking, then that means that the bush-molester had a somewhat reasonable expectation of privacy. As for the open blinds thing... I think that is largely situational. If your house is right on the street, that's one thing; if it's half an acre's width back from the road, that's another. Again, 'reasonable expectation'. If you know people can see what you're doing from the street or neighboring houses, you probably shouldn't do anything you want privacy for.

Doesn't matter in Florida. If you are naked outside and some pervo sees you and calls the cops, you get charged if they can prove it.
